Understanding Title Insurance

A title search lists the current owners, if taxes are paid and any liens/judgments on the property. Your title insurance protection is a permanent assurance that your ownership and use will be defended promptly against claims at no cost to you, whether the claim is valid or not.

Types of Title Insurance Policies

There are two types of title insurance policies. Both policies cover losses to no right of access to the land.

Owner’s Policy

When purchasing a home, it is highly advised to purchase an owner’s policy to protect the property search from all defects, liens and encumbrances unless there are any exceptions.  A few examples of these are undisclosed heirs, falsified affidavits,
fraudulent documentation.

Lender’s Policy

The mortgage lender will require a borrower to purchase title insurance to protect the institution’s position as a holder of the mortgage loan.  This is a one-time premium for the duration of the loan unless the borrower refinances.

Upon receiving a new title order, a search is done on the Florida property. Trilogy Title & Closing will obtain the necessary documentation to clear liens and encumbrances or we will payoff any debts during the closing process.  You will work with a specific Trilogy Title & Closing experienced staff member who will walk you through every single step of the process to clear your title and ensure a smooth and flawless closing.    If needed, we offer additional services such as deed preparation, Power of Attorney review and preparation, ordering homeowner’s insurance declaration pages, and processing subordinations.
